Evans v. Lorillard Tobacco

In this Engle progeny tobacco litigation proceeding, plaintiff Will Evans (personal representative of the estate of Marie Evans) alleged Lorillard Tobacco Company of targeting youths and minorities with free Newport cigarette giveaways and fraudulent concealment of dangers of smoking cigarettes, which got his mother Marie Evans addicted to smoking at an early age of 13. The plaintiff also alleged the company of manufacturing defective cigarettes, due to which Mrs. Evans died of Lung cancer at age 54, in the year 2002.

The plaintiff was represented by attorneys Michael Weisman and Thomas Frisardi. The defendant in this case, Lorillard Tobacco Company was represented by attorneys Paul Ware, Kevin Martin and Andrew McElaney.

The jury found in favor of the plaintiff on all questions and awarded $71M in compensatory damages, and $81M in punitive damages.
