In this Engle progeny lawsuit, plaintiff, the widow of smoker smoker Paul Baum, claims that Baum was addicted to cigarettes and that his 50-plus-year smoking habit caused and aggravated the chronic obstructive pulmonary disease that ultimately killed him in 2012. Defendants contend that Baum was a smoker by choice rather than an addict. Defendants also claim that plaintiff is not an Engle class member because Baum suffered from tracheomalacia unrelated to his smoking.
